The Consequences Of A DUI

Pennsylvania imposes the following mandatory minimum sentence for a first-time DUI charge:

  • Six-month probation
  • $300 fine
  • Alcohol traffic safety education

A first-time charge typically does not warrant a suspension.

After the first time, penalties begin to get more severe. Subsequent offenses can result in the following penalties:

Second offense

  • Ungraded misdemeanor
  • One-year license suspension
  • Up to six months in jail
  • Up to $2,500 in fines
  • One year of an ignition interlock

Third or subsequent offense

  • Second-degree misdemeanor
  • One-year license suspension
  • Up to two years in jail
  • Up to $5,000 in fines
  • One year of an ignition interlock

Aggravating factors, like a particularly high blood alcohol content (BAC), may result in harsher penalties, including a first-degree misdemeanor and up to five years in jail.

The expense of a DUI conviction includes higher insurance costs, the time and expense of reinstating your driver’s license, fines, and substantial cost of the initial installation of the ignition interlock device and the monthly maintenance and service fees you must pay.
